Microsoft will share more information about its Windows 8 app store at a special event Tuesday.

Slated to take place in San Francisco, the two-hour Windows Store preview event should provide the latest details about the Windows Store to the invited developers and members of the press.

Microsoft has been mum about the Windows Store lately, but it did reveal some facts at its Build conference in mid-September.

Trying to outdo Apple’s Mac App store, the Windows Store will let users download free trial copies of Metro-style apps to check out for a limited time. So developers won’t have to cook up both paid and “lite” versions of their applications. Beyond that, both free and paid apps would be available. Microsoft will also run security checks and other tests to certify each app.

Traditional Windows desktop and Metro-style apps would both be accessible through the Windows Store, according to Mary Jo Foley of CNET sister site ZDNet. However, Windows desktop apps will not be directly downloadable but instead would be offered through a link to the third-party developer. Microsoft’s demo at Build showed a link to download Quicken, as one example. Metro-style apps would be available only through the Windows Store.

Developers will also be able to promote their Windows 8 Metro apps via their own Web site, according to WinRumors. From the developer’s site, users could click on a download button that will bring them to the Windows Store where they can grab the application directly.

Foley also posed the question of whether there might be any tie-in between the Windows Store and Microsoft’s Xbox 360 because Tuesday is the day that Xbox users will see a new dashboard.

In July, CNET sister site GameSpot cited a rumor claiming that Windows 8 users would be able to play Xbox 360 games directly from their PCs and other Windows devices.

This week, Microsoft Chairman Bill Gates is slated to take the stand as a witness for Microsoft in the ongoing Novell Microsoft antitrust trial.

Yawn.

This is a trial about events that occurred in the mid-1990s when Microsoft was developing Windows 95. It centers around WordPerfect — a product Novell sold to Corel 12 years ago. Novell itself was purchased recently by Attachmate.

What’s the back story behind Novell’s beef? In 2004, Novell settled one potential antitrust suit with Microsoft involving NetWare for $536 million. But Novell refused to settle with Microsoft over antitrust claims around its WordPerfect and Quattro Pro products at that time.

Novell claimed Microsoft withheld interoperability information it needed to enable those products to run well on Windows. Microsoft tried to get Novell’s complaint dismissed, claiming that it was Novell’s “own mismanagement and poor business decisions” that tanked WordPerfect and Quattro Pro. Plus, Microsoft argued, since Novell sold WordPerfect to Corel over a decade ago, their claims should be barred under the Statute of Limitations.

The majority of Novell’s claims in this matter had previously been dismissed. A federal appeals court judge agreed earlier this year to allow the remaining unsettled claims to proceed.

As reported last week by The Salt Lake Tribune:

“An email Gates wrote in October 1994, 11 months before the launch of Windows 95, is at the heart of Novell’s case. In it, Gates, who was CEO at the time, decided to not include several software code features in Windows 95, the highly successful personal computer operating system released in August 1995.”

I am one who believes Microsoft officials engaged in a number of practices that abused the company’s monopoly power in the 1990s. But Microsoft already has been on trial for those activities and was required to adjust some of its policies as a result. Whether or not one believes the company was judged justly, the industry has moved on at a rapid pace since then.

Novell is claiming it lost $1 billion because of Microsoft’s alleged anticompetitive actions and is said to be seeking tens of millions of dollars in damages from Microsoft. The Novell-Microsoft trial, which has been going on for three-plus weeks, is at its projected half-way mark.

Microsoft has begun presales for the Surface 2.0, its second-generation table-sized tablet computer. Priced at several thousand dollars, the Surface won’t likely find a sizable niche in the consumer space; rather, it’s targeted at commercial clients. “Most of these units have been going into shared facilities — places like casinos, hotels and restaurants,” said McGregor.

The Microsoft  Surface 2.0, a coffee-table-sized, tablet-like touchscreen computer, is ready for preorder in 23 countries, including the United States.

The Surface first emerged in 2007 and used cameras and its touchscreen to interact with people and objects. The model available for preorder is called the “SUR40” and is manufactured by Samsung. Microsoft indicated it will focus on the commercial business and professional audience, including education, professional services, healthcare and retail. Units are expected to ship by early 2012.

The SUR40 has a diagonal size of 40 inches with a 1080p screen resolution of 1,920 by 1,080. The Surface 2.0 no longer relies on the cameras of the original model. The unit has a feature called “PixelSense,” which allows the LCD to recognize fingers, hands and objects placed on the screen, including more than 50 simultaneous touch points. The pixels see what is happening on the screen and immediately interpret the data.

The SUR40 is only four inches thick, so it can be mounted on walls or installed into custom enclosures. Microsoft has distributed tools to developers so that apps can take full advantage of the technology. Microsoft and Samsung have not released a price point yet, but reports put the tag between US$8,400 and $15,000. The SUR40 recently made Popular Science’s Best of What’s New list.

The price point could discourage wide sales. Given that, sales will probably be restricted to businesses.

“This is still too pricey for most folks,” Roger Kay founder and principle of Endpoint Technologies, told TechNewsWorld. “Microsoft and Samsung are perhaps trying to skim the very top demographic with a more consumerish look.”

There will be a few individuals who will want this in their living rooms, noted Kay.

“Most of these units have been going into shared facilities — places like casinos, hotels and restaurants,” said Kay.

Given that, Kay thinks Surface is pretty fun. “So it will become an expensive toy for a few, and an interesting tool for commercial establishments,” said Kay. “Over time, the price could come down and more individuals would buy it.”

The product won’t likely attract a large number of developers, Kay added.

“Developers respond to customer needs,” said Kay. “So if a casino wants a drink-ordering, tab-keeping app, a developer will step up and do it. If the price comes down to, say, under $2,000, then a larger market could develop, but that could take a while.”
Big Screen for Big Buyers

With the large screen and the horizontal surface, the Surface is designed for simultaneous, collaborative use.

“This is a niche application that could be used for sales, design collaboration and gaming,” Jim McGregor, chief technology strategist at In-Stat, told TechNewsWorld. “Haven’t you sat at a bar in Vegas and played video poker? Well, you could do it on this.”

Developers, McGregor said, will work with Surface if it connects with the user’s game console, cellphone and tablet, but he is doubtful the product will find a large market.

“The point is, you don’t need the entire performance of a PC or the bulk of a Windows OS. I see very little need for a full-blown PC in a horizontal configuration,” said McGregor.

“I think you’ll start seeing more large screens for a variety of functions and many will be computing devices,” he added. “The question is, will they be full-blown PCs?”

“What you end up with is a PC that is not ergonomically friendly and is still rather bulky because of the use of traditional screen technology,” McGregor explained.

If the product had some groundbreaking features, it may have some real value.

“If you could use 3D holographic projections, this would be seriously cool, but we are not there yet,” said McGregor. “The result is a different orientation of a PC for niche markets and applications. However, it does demonstrate different usage models, such as design collaboration.”

Microsoft will start allowing developers to preview Windows 8 Embedded in the first quarter of next year, with plans to eventually release its embedded computing products in the quarters following the Windows 8 desktop version launch.

The next version of Windows Embedded Enterprise will release within one quarter after Window 8 becomes available, said Ben Smith, director of program management for Microsoft’s Windows Embedded business, during a news briefing last week. Windows Embedded Standard will release within three quarters of the Window 8 launch, he said.

Microsoft’s Windows 8 desktop version is expected to be released some time in 2012.

Smith declined to reveal what changes the new versions will include, but said they will use “natural user interface” technologies, a term Microsoft has used to describe products that rely on touch or speech to complete commands. Windows Embedded Standard will also run on ARM processors.

“Windows 8 not only represents potential innovation in the PC experience, but also in the world of specialized devices,” Smith said. “We at Windows Embedded are working very closely with the Windows client team to bring that innovation to specialized devices.”

Windows Embedded is a family of operating systems tailored to be used on specialized devices built with processors, such as kiosks, medical equipment and construction machinery. But Microsoft expects the scope of Windows Embedded to evolve as more devices including everyday objects like refrigerators and even thermometers become fitted with processors.

Now processors have not only become more powerful, but also cheaper in cost and physically smaller, Smith said. Improvements in connectivity also mean that devices can be constantly connected with the Internet.

This paves the way for “intelligent systems”, Smith said, which involves taking everyday objects to collect data over a network that can then be used by a company or user to improve operations. An example of this could be a clinic, where all the medical equipment and computers are connected together over a network, allowing doctors to easily keep up-to-date medical records that can then be shared with the patient.

“In intelligent systems, data will be the new currency,” he said. “We know the market is excited for intelligent systems and we are too.”

The intelligent systems market already generates $1 trillion in revenue annually, according to research firm IDC. But by 2015, the revenue is expected to double.

Microsoft appears to be having its way in its ongoing campaign to extract licensing fees from manufacturers of devices running Google’s Android operating system. The latest to join its camp is Samsung. “This move shows that the largest Android OEM does not believe that Google will be able to protect the ecosystem,” said Michael Morgan, senior analyst for mobile devices at ABI Research.

Microsoft (Nasdaq: MSFT) and Samsung have signed an agreement to cross-license their patent portfolios, providing broad coverage for each company’s products. Microsoft will receive royalties for Samsung’s Android-powered mobile phones, and the companies have agreed to focus on further development and marketing of Windows-powered smartphones.

Samsung recently launched the Omnia W, its first smartphone to run on Windows Phone 7.5, also known as “Mango.”

The details on how much Samsung is paying and exactly what it is paying for remain undisclosed. It is still unclear whether the deal will involve retrospective royalties or will be limited to devices sold after it goes into effect.

Microsoft has been growing more aggressive in securing licensing agreements with manufacturers that use smartphone technology. It recently signed similar deals with HTC, Acer, Viewsonic and multiple other device producers.

Motorola and Barnes & Noble (NYSE: BKS) have refused to sign patent deals with Microsoft for their respective devices.

Pressure on Google

The agreement between Samsung and Microsoft will ultimately put pressure on Android developer Google (Nasdaq: GOOG), which is planning to acquire Motorola.

“The cross-licensing deal between behemoths Microsoft and Samsung will mean more pressure on Motorola and Google to come to terms,” Raymond Van Dyke, a Washington, D.C.-based technology and IP attorney, told the E-Commerce Times. “The stakes could not be higher in tech: dominance in the smartphone arena. This deal helps Samsung — the number two manufacturer of smartphones — and Microsoft.”

The deal demonstrates the power of a patent portfolio to provide the requisite leverage to get the parties to cooperate for their mutual good, Van Dyke noted. “The ongoing patent suits against Motorola will keep that pressure going while also putting pressure on Google.”

The move also provides great business drama.

“As the titans in the tech industry hurl patent thunderbolts at each other, form alliances, and push their agendas, we common folk will marvel as the saga unfolds,” said Van Dyke.
Samsung’s Strategy

The deal shows clever positioning on Samsung’s part. The royalty payments buy the goodwill to help solidify a major alliance.

“This is very smart strategically for Samsung,” Christopher M. Collins, a patent attorney for Vanderpool, Frostick & Nishanian told the E-Commerce Times.

“So long as they didn’t overpay for the licenses — which I think that they probably did not — then this opens the door for Samsung to move forward,” he added. “Also, the Microsoft angle is to go after the rest of the market now that this is settled.”

The move is evidence that Microsoft is going to focus on Motorola as a major competitor, in Collins’ view.

“Microsoft can clear the decks of the entire Samsung matter — money, time and other resources — and will now be redirected to the Motorola litigation,” he said.

The strategy might not have legs over the long term, however.

“In the short term, this deal will be good — a smart strategic move for both sides,” said Collins. “In the long term, not so much. I predict that these two partners of convenience will have other disputes in the not-too-distant future.”
Samsung Happy to Fork Over Royalties

The royalty payments are simply a recognition of Microsoft’s IP rights, according to Samsung, which underscored its ongoing alliance with Google in the same breath.

“As Samsung respects Microsoft’s innovation and intellectual property rights in mobile operating systems, we’ve agreed to provide royalties in relation to these intellectual property rights,” Kim Titus, director of public relations at Samsung Telecommunications America, told the E-Commerce Times.

“We are very pleased with the great success of our innovative Galaxy range of smartphones and tablets powered by Android platform. Today, we are the world’s leading producer of Android smartphones and enjoy a strong partnership with Google,” she pointed out.

Samsung’s dual alliances with Microsoft and Google are simply a matter of providing support for customers, the company maintains.

“As always, the mix of mobile platforms represented within our device portfolio will be determined based on consumer demand and preferences in each market,” said Titus.
Nifty Outcome

This deal appears to be a win for both companies. The consolidated license portfolios could be a powerful tool in a market where Microsoft has struggled to stay afloat.

“I view this as the best possible outcome for Microsoft and Samsung, considering that Microsoft has continued to get licensing wins with other key Android OEMs,” Michael Morgan, senior analyst for mobile devices at ABI Research, told the E-Commerce Times. “In this case, it is a classic example of players cross-licensing their patent portfolios, whereby one player reduces the initially requested costs by sharing their IP.”

The Samsung-Microsoft deal may have created a sea change in the smartphone market.

“With Samsung now capitulating to Microsoft, I view this as the tipping point in this battle, whereby those who have not yet agreed to licensing fees to Microsoft will begin to focus on getting the best deal that they can,” said Morgan. “Microsoft will continue to leverage its IP strength and expertise and turn Android from a pure competitor into a revenue stream.”

Google is going to have a tough time promoting Android as a free and open system going forward, he suggested.

“Only time will tell if having to pay Microsoft for Android will actually put a dent in Android adoption by OEMs,” said Morgan. “It is still unclear if it will be profitable to engineer around the Microsoft IP over the long term or if paying a ‘Microsoft Tax’ on Android is the best option in terms of cost and strategy.”

The subtext to the deal may be that Google has lost some of its strength in the smartphone market.

“Ultimately,” concluded Morgan, “this move shows that the largest Android OEM does not believe that Google will be able to protect the ecosystem.”
